Geregistreerde jeugdmisdadigheid en gerechtelijke selectie

Abstract

Registered juvenile delinquency and judicial selection - While the process of juvenile justice is primarily judico-legal in nature, many extra-legal variables tend to become prime determinants in the decision-making process at all levels of the administrative system and thereby affect the character and extent of a juvenile offender’s involvement in that system. Indeed, progression of a juvenile through the different stages of the juvenile justice system is dependent on the discretionary decisions of various functionaries such as the police, the prosecutor and the juvenile court judge. However, little substantial evidence is available on the way that discretionary power is used and the sorts of criteria on which such decisions are based. This study, based on findings of various researchers, is meant to broaden our knowledge of the juvenile justice system and how it works in day to day life.
