Het slachtoffer en de totstandkoming van het misdrijf
Abstract
The victim and the realisation of crime - This article deals with the psychological dynamics of the female victim. In West European societies the role of victim is easily attributed to women. Although the emancipation of women brought along a certain kind of liberation, women are generally in a subordinate position and have not yet found their own identity. Traditionally it has been expected from women that they play an inactive role in their relationship with men. The psychological difference between men and women means that women should be freer and that they, themselves, should decide their own sexual engagements, an attitude which would confuse men in their traditional approach. Rape especially is an example of women being victimized by men. Criminological studies on rape study the provocation of women; the analysis of some 500 rapes reveals that at least in half of the cases both partners already had had contacts with each other before the crime act. In Belgian law concerning rape, the mutual responsibility of both partners should be emphasized, while the sexual implications of the act, against which women should be „protected”, should be minimized. Rape should be considered only as a psychological and a physiological act of violence.
