Het seponerings- en vervolgingsbeleid in jeugdzaken van het openbaar ministerie

Abstract

Decision-making in juvenile cases by the public prosecutor — One of the central issues in contemporary criminology is the extent to which social characteristics affect dispositional outcomes of registered juveniles. With regard to the juvenile justice system, recent research indicates that a selection process operates at every stage in the sequence of organizational processing within the system. This fact alone has provided ample justification for the large number of research efforts undertaken for the purpose of identifying some of the factors which are considered in dispositional decisions and of examining their relative importance in the decision-making process. The present research was designed to explore differences between youths who were released by the public prosecutor and youths who were processed at the juvenile court level. The data of this study, gathered from one jurisdictional area and examined by multiple regression-analysis, re-assess the effect of social characteristics on the prosecural decision. Furthermore, the analysis indicates the differential effect of legal and social factors according to sex and type of offence committed.
