Database and catalogue of the early modern differentiae iuris civilis et canonici


Abstract

This paper presents the contents of an online database of the early modern differentiae iuris civilis et canonici and an accompanying catalogue (https://zenodo.org/records/13090865). Differentiae listed the discrepancies between civil (Roman) law and canon law and often provided some insights into how conflicting laws could be reconciled. The paper describes the relevant literature on the subject, the premises behind the composition of the catalogue and its contents, and selected problems that arose in the process.
